Terms of Service

These Terms of Service (the “Terms”) govern the use of VisiQ, an online booking service for small service businesses, and of the visiq.us website. By creating a business account, or by using the service to make a booking, you agree to these Terms. If you register on behalf of a business, you accept them on behalf of that business.

The visiq.us website and the VisiQ service are operated by VisiQ. Contact e-mail: info@visiq.us.

1. Who we are

In these Terms, “VisiQ”, “we” and “us” mean the operator named above. “Business” or “you” means a business that has a VisiQ account. “Client” means a person who books an appointment with a Business through VisiQ.

2. The service

VisiQ lets a Business publish a public booking page with its services, prices and opening hours, and lets Clients request appointments on that page. Clients confirm their booking through a link sent by e-mail, and the Business can manage, confirm or cancel bookings in its dashboard. VisiQ sends the related e-mail notifications to the Business and to the Client.

We are continuously developing the service. Features may be added, changed or removed over time; if a change significantly reduces what you are using, we will tell you in advance where reasonably possible.

3. Accounts

Business accounts are intended for businesses and self-employed professionals, not for private consumers.

  • The person creating an account must be at least 18 years old and authorised to act on behalf of the Business.
  • The information you provide (business name, e-mail address, services, prices, opening hours) must be accurate and kept up to date.
  • You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately at info@visiq.us if you suspect unauthorised access.
  • New accounts are reviewed and approved by us before the booking page becomes available. We may decline an application without giving detailed reasons.
  • We may suspend or close an account that breaches these Terms, is used for abuse or fraud, or puts the service, Clients or other users at risk. Where appropriate, we will warn you first and give you a chance to fix the problem.

4. Free period

Every Business that signs up gets the first 6 months free of charge, with all features that are available in the service at the time. No payment card is required to sign up, and nothing is charged automatically.

At least 30 days before your free period ends, we will send you an e-mail explaining your options: moving to one of our paid plans, or continuing on the free plan with its limits. Nothing is charged unless you explicitly choose a paid plan. If you do not choose anything, your account continues on the free plan.

5. Plans, prices and limits

The plans, prices and limits that apply after the free period are described on our website. We may change plans, prices or limits by giving at least 30 days' notice by e-mail. A change does not apply to a period you have already paid for. If you do not agree with a change, you may stop using the paid plan or close your account before the change takes effect.

6. Acceptable use

You must not use VisiQ, or allow others to use it, to:

  • send spam or unsolicited marketing messages, including through the booking or contact forms;
  • offer or advertise services or goods that are illegal, or content that is unlawful, misleading, offensive or infringes the rights of others;
  • create fake, automated or bulk bookings, or book appointments you do not intend to attend in order to block other people;
  • attempt to gain unauthorised access to the service or other accounts, interfere with its operation, or circumvent its security or usage limits;
  • collect personal data of Clients or other users for purposes unrelated to the bookings made with you.

7. Your services and your Clients

The Business alone is responsible for the services it offers, their description, prices, quality and delivery, and for its relationship with its Clients, including cancellations, refunds, complaints and compliance with consumer protection, tax and industry rules that apply to it.

VisiQ only provides the technical tool. We are not a party to any booking or agreement between a Business and a Client, we do not provide the booked services and we do not handle payments between them.

8. Availability of the service

The service is provided “as is” and “as available”. VisiQ is at an early stage and we do not guarantee any particular uptime or that the service will be free of errors or interruptions. We carry out maintenance and updates, preferably at times of low use, and we make regular backups, but you should keep your own record of important appointments.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, such as lost profits, lost revenue, lost bookings or damage to reputation, or for losses caused by events beyond our reasonable control. Our total liability to a Business for all claims in any 12-month period is limited to the greater of the fees that Business paid us in that period or EUR 100.

Nothing in these Terms limits or excludes liability for damage caused intentionally or by gross negligence, for death or personal injury, or any other liability that cannot be limited or excluded under applicable law, including mandatory consumer protection law.

10. Termination, data export and deletion

You may stop using VisiQ and ask us to close your account at any time by writing to info@visiq.us from the e-mail address of your account. We may end the service for a Business with 30 days' notice by e-mail, or immediately in the cases described in section 3.

Before closing your account, you can ask us for an export of your data (for example your services and bookings) in a common machine-readable format. After the account is closed, we delete your account data and your Clients' booking data within 30 days, except where the law requires us to keep certain records for longer (for example accounting records for paid plans). Copies in our backups are overwritten in the normal backup cycle, within 30 days.

11. Data Processing Agreement (GDPR Art. 28)

This section forms the data processing agreement between the Business and VisiQ required by Article 28 of the General Data Protection Regulation (EU) 2016/679 (“GDPR”). It applies to personal data of Clients that VisiQ processes for the Business.

Roles. For booking data of its Clients, the Business is the controller and VisiQ is the processor. Subject matter and duration: provision of the booking service for as long as the Business has an account. Nature and purpose: storing, displaying and managing bookings and sending booking-related e-mails. Data subjects: the Business's Clients. Categories of data: name, phone number, e-mail address, the booked service, date and time, booking status and any note the Business adds (such as a rejection reason). The Business must not use VisiQ to collect special categories of personal data (such as health data) in free-text fields.

VisiQ commits to the following:

  • Instructions: we process Client data only on the Business's documented instructions, which are these Terms and the Business's use of the service settings, and only to provide the service, unless EU or Latvian law requires otherwise (in which case we will inform the Business unless the law forbids it). We will tell the Business if we believe an instruction infringes data protection law.
  • Confidentiality: only persons who need access to run and support the service can access Client data, and they are bound by confidentiality.
  • Security: we apply appropriate technical and organisational measures, including encrypted connections (TLS/HTTPS), passwords stored only as one-way hashes, role-based access control, rate limiting against abuse, and regular database backups kept for a limited time.
  • Sub-processors: the Business gives general authorisation for us to use sub-processors. Our current sub-processor is Hostinger International Ltd (web hosting, database and e-mail sending). We will notify Businesses by e-mail of any intended addition or replacement of sub-processors in advance, giving the Business the opportunity to object; if we cannot reasonably accommodate the objection, the Business may close its account. We impose data protection obligations on sub-processors equivalent to those in this section.
  • Data subject requests: taking into account the nature of the processing, we assist the Business in responding to requests from Clients exercising their GDPR rights. If a Client contacts us directly, we will refer them to the Business.
  • Personal data breaches: we notify the Business without undue delay after becoming aware of a personal data breach affecting its Client data, with the information available to us, and assist the Business in meeting its own obligations under Articles 32 to 36 GDPR.
  • End of processing: when the account is closed, we delete the Client data (or return it on request before deletion) within 30 days, unless the law requires us to keep it.
  • Audits: on request, we provide the Business with the information necessary to demonstrate compliance with this section and allow for and contribute to reasonable audits, including inspections by an auditor mandated by the Business, with reasonable prior notice.

12. Changes to these Terms

We may update these Terms, for example when the service or the law changes. We will notify Businesses of material changes by e-mail at least 30 days before they take effect. If you continue to use the service after that date, the updated Terms apply. If you do not agree, you can close your account before the changes take effect.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Latvia. Disputes will be resolved by the courts of the Republic of Latvia. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence. We would always prefer to resolve a problem amicably first, so please contact us.
